What To Know About Pres. Trump’s “Chokehold Ban”

On Monday June 16, President Donald Trump gave a speech and signed an executive order concerning nationwide policing. After the signing, many outlets reported the President banned police from using chokehold techniques, or reports of a similar manner. Stipulation deems these reports to be UNBIASED and mostly true.

Context

Following calls for major law enforcement reform, the Trump administration outlined a variety of reforms with the aim “to uphold clear and high policing standards [and] promote accountability in law enforcement…” Among the policy recommendations – which include increased inter-department information sharing and expanded training for encounters with people with mental illness, homelessness, and/or addiction – was the prohibition of chokeholds. The pertinent section of Safe Policing for Safe Communities executive order reads:

“The Attorney General’s standards for certification shall require independent credentialing bodies to, at a minimum, confirm that… [T]he State or local law enforcement agency’s use-of-force policies prohibit the use of chokeholds — a physical maneuver that restricts an individual’s ability to breathe for the purposes of incapacitation — except in those situations where the use of deadly force is allowed by law.”

While executive orders are not laws, per se, they do have the force of law. For this case, this means that Pres. Trump has ordered all federal, state, and local law enforcement agencies to cease the use of chokeholds – unless an officer’s life is threatened.

While this is an extensive federal reform, it is important to note that many police departments and cities have already banned chokeholds.
